Editorial:Does Microsoft deserve to be sued?

A class action lawsuit out of Texas(sorry, no link) recently accused Microsoft of taking people's money in return for a service(xboxlive) without actually delivering that service. I don't know if any of you actually experienced the problms with xboxlive recently, but they were rather crippling Id have to say. It made trying to compete online almost futile. So, should Microsoft be sued? The group responsible for the suit claims that Microsoft was aware that the xmas season would bog down their servers, and they failed to prepare properly for the problem, although they continued to accept payments. Let me know what you think...
